In a just society cannabis would not be a crime

Levi - 07/07/10

At roughly midnight on the 7th July Police stopped me on the street because of the bag i was carrying. The bag contained some scrap wiring i had been given at my friend's, and a large, but unused spotting device. Upon seeing the copper wire, and unbelievably, the soccer gloves in my jacket pocket, the police asked if i thought they were stupid and invoked a search. I told them that if they would take me to my friends house he would surely explain that the copper was legally aquired . The search went ahead. It resulted in the seizure of a small bud in my wallet, a bamboo pipe, and several unused items. After being arrested, the police finally took me to my friends to investigate the wire. Though they asked me lots of times whether Mike was a real person, he was able to show them where he got the wire and i was able to keep it. Had the police investigated before searching me, they would have found i was no criminal and there was never a reason to search me.

For Sure, you were not doing anything wrong. The best option is to challenge the charges. Let the Duty Soliciter know that you wish to Plead either Not Guilty or No Plea.

A number of defendants have had utensils charges dropped after requesting a Jury. Jury trial are not very common and they often drop the charges rather than going to the effort of prosecuting.

2nd court date passed - still fighting

1st appearance, entered no plea, refused to work with first duty solicitor as he made me feel like a criminal. 2nd duty solicitor was nice, willing to help me, and entered my plea along with applying for legal aid so he could represent me.
2nd appearance, entered a not guilty plea and asked for full disclosure of evidence against me. my reason for entering not guilty? I disagree with current cannabis laws and believe otherwise law abiding citizens should not be prosecuted and criminalized.
Status hearing on the 10th august, i'm not sure where to go next.

where to next?

Good work. Great to get the disagree with the law bit in.
It's good to be respectful to the people but strong about the law being unjust.
Not too much happens at the status hearing, they will look thru the evidence and set a date for the final defended hearing.
It may not be nessesary to elect a jury, as they are reserved for more serious charges. Having said that possession of utensils is considered serious enought to make a jury an option for one of the charges.
In many cases utensils charges have been dropped before reaching the final stage.
